How long do I have to file a workers’ comp claim in Massachusetts?

In Massachusetts, you must file a workers’ compensation claim within four years of the date you realized you sustained a work-related injury/illness. This is referred to as the statute of limitations. For cases involving the death of a worker, a claim must be filed within four years of the date of the worker’s death.

While most workers who sustain a work injury/illness report it to their employer right away, some work-related injuries/illnesses take a long time to manifest (e.g., repetitive motion injuries, cancer, etc.). That’s why there is such a lengthy deadline to file a claim.

How long do I have to file a workers’ comp claim in Rhode Island?

Under Rhode Island law, you have two years from the date you became aware of your work injury or illness to file a workers’ compensation claim. In most cases, if you miss this deadline your claim will automatically be denied, though there are some exceptions.
